1. About Member Bot

Member Bot is a Telegram-based subscription platform that enables content creators in Kenya to offer paid access to their Telegram channels and groups. Subscribers pay via M-Pesa and receive automatic access to the channels they subscribe to.

Member Bot is operated as a platform connecting creators and subscribers. We are not responsible for the content published in any creator's channel beyond ensuring that access management works as described.

2. Eligibility

To use Member Bot you must:

• Have an active Telegram account
• Be at least 18 years of age, or have parental/guardian consent
• Have access to a valid M-Pesa account registered in Kenya (for paid subscriptions)
• Comply with Telegram's own Terms of Service

3. Subscriptions

When you subscribe to a channel through Member Bot:

• Your subscription begins from the moment your payment is confirmed by Safaricom.
• Subscription duration is calculated from the exact time of payment confirmation — not from midnight or the start of the day.
• Renewing before expiry adds the new duration on top of your remaining time (for the same category). Renewing after expiry starts a fresh subscription from the moment of renewal.
• Access codes activate from the exact moment of redemption and run for the code's stated duration.
• Subscriptions do not automatically renew. You must actively renew when prompted.

4. Payments

All payments are made via M-Pesa (Lipa Na M-Pesa — Buy Goods). By initiating a payment you agree to the following:

• You authorise the deduction of the stated subscription amount from your M-Pesa account.
• Payments are processed by Safaricom via their Daraja API. Member Bot does not handle or store your M-Pesa PIN at any point.
• The price displayed at the time you select a plan is the price you will be charged. If a plan's price changes between when you browse and when you submit your phone number, your payment request will be cancelled and you will be shown the updated price.
• If you already have a pending payment for the same plan, a second STK Push will not be sent. You must wait for the first request to complete or time out.

5. Refunds

All subscription payments are non-refundable once access has been granted. This includes:

• Subscriptions where the subscriber did not use the channel during the subscription period
• Subscriptions where the subscriber was removed for violating channel rules set by the creator
• Accidental payments for the wrong plan

If a payment was charged but access was not granted within 30 minutes, contact us via @BNNCREATORBOT and we will investigate and resolve the issue.

If you received a 10% sales recovery discount offer and completed that payment, the discounted amount is also non-refundable once access is granted.

6. Access and Channel Rules

• Invite links generated by Member Bot are personal and non-transferable. Do not share your invite links with others.
• Sharing access links constitutes a breach of these Terms and may result in your account being suspended without refund.
• Each creator sets their own rules for their channel. Member Bot is not responsible for enforcing those rules but may revoke access if instructed by a creator for a valid reason.
• Member Bot may revoke your access if you are found to be abusing the platform, submitting chargebacks, or violating Telegram's Terms of Service.

7. For Creators

If you operate a channel or group through Member Bot as a creator, you additionally agree to the following:

• Revenue share: You will receive a percentage of gross subscription revenue as follows — 80% on the first KES 10,000 per payout cycle, 85% on KES 10,001–100,000, and 90% above KES 100,000. The platform retains the remaining percentage as a service fee.
• Payouts: Payouts are processed to the M-Pesa number registered on your creator profile. You are responsible for keeping this number accurate and up to date.
• Content responsibility: You are solely responsible for the content published in your channels. You must not use Member Bot to distribute illegal, harmful, defamatory, or fraudulent content.
• Subscriber obligations: You must deliver the subscription content or service that was advertised to subscribers. Persistently failing to do so may result in your account being suspended.
• Taxes: You are responsible for declaring and paying any applicable taxes on income received through Member Bot. Member Bot does not withhold tax on your behalf.

8. Prohibited Conduct

You may not use Member Bot to:

• Submit fraudulent payments or initiate chargebacks after receiving access
• Distribute malware, phishing links, or illegal content
• Automate interactions with the bot in a way that degrades service for others
• Attempt to gain unauthorised access to channels you have not subscribed to
• Harass, abuse, or threaten other users or creators
• Use the platform in any way that violates applicable Kenyan law or Telegram's Terms of Service

Violations may result in immediate suspension of your account without notice or refund.

9. Availability and Interruptions

We aim to keep Member Bot available at all times but cannot guarantee uninterrupted access. Maintenance, Safaricom API outages, or Telegram platform issues may temporarily affect the service. We are not liable for losses arising from service interruptions beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Member Bot and its operators shall not be liable for:

• Loss of data, revenue, or profit arising from use of the platform
• Content published in creator channels
• Losses resulting from M-Pesa payment failures, delays, or Safaricom API errors
• Any indirect, incidental, or consequential damages

Our total liability to you for any claim arising out of use of the platform shall not exceed the total amount you paid for your most recent subscription.

11. Changes to These Terms

We may update these Terms at any time. When we do, the "Last updated" date at the top of this page will be revised. Continued use of Member Bot after changes are posted constitutes acceptance of the updated Terms. We will attempt to notify active users of material changes via the bot.

12. Governing Law

These Terms are governed by the laws of Kenya. Any disputes arising from use of the platform shall be subject to the jurisdiction of the courts of Kenya.
